A temporary petition for the protection of victims of intimidation filed against Amy Thomas, the wife of the public prosecutor, was quashed at noon Monday by Justice Dan Rullo of the Somerset County Court of Common Pleas.
the same judge, who granted his request and set a hearing date for October 1, quashed the protection order and canceled the hearing.
“Upon further research, we find that the Temporary Protection Against Bullying Order issued on September 23, 2021 was granted recklessly,” Rullo wrote in a court order.
Careless means the court should not have accepted the case, according to Black’s Law Dictionary.
A woman from Windber filed the petition and a temporary request for the protection of victims of sexual violence against Somerset District Attorney Jeffrey Thomas on Thursday. The action against the district attorney is still on the court’s list for October 1.
Jeffrey Thomas, 36, was arrested on Wednesday and charged by state police with rape, indecent assault, strangulation, common assault and criminal trespass over an incident that allegedly took place September 18 at a woman’s residence in Windber.
